Scope
This privacy policy applies to:
- Sykes Assistance Services Corporation employees, including contractors and service providers providing services on its behalf;
- Any personal information that identifies an individual, in whatever form or medium (paper, digital, electronic, audio-visual, graphic) created or received in the course of carrying out mandated functions and activities, and
- All facilities and equipment required to collect, manipulate, transport or keep Sykes Assistance Services Corporation information.
Legislative Requirements
- The Personal Information Protection and Electronic Documents Act (Canada) (PIPEDA) and the Policies and Procedures of Sykes Assistance Services Corporation protect the personal information of the public and employees of Sykes Assistance Services Corporation. The Law Society of Upper Canada through its Rules of Professional conduct further protects the personal and confidential information of clients held by lawyers by attaching a solicitor-client privilege to the relationship. PIPEDA governs the collection, use and disclosure of personal information by organizations by balancing the right of an individual to have his or her personal information protected and the need of an organization to collect, use or disclose personal information for purposes that are reasonable.

Sykes Assistance Services Corporation is committed to protecting the privacy of individual employees and clients. To that end Sykes Assistance Services Corporation has implemented a privacy program to meet the following privacy goals:
Accountability
Sykes Assistance Services Corporation is responsible for protecting the confidentiality of personal information in its custody or under its control in compliance with the applicable federal legislation and provincial rules.
Sykes Assistance Services Corporation has identified and designated a Privacy Officer to be responsible for implementing the privacy program and ensuring compliance with legislation and rules.
Openness
Sykes Assistance Services Corporation develops and follows privacy and security policies and practices that are compliant with legislation and provincial rules. Such policies and practices are publicly available.
Collection and Consent
Sykes Assistance Services Corporation collects personal information only for reasonable business purposes and with the consent of the individual or authorized representative, except where otherwise authorized by legislation.
Identifying Purposes
Sykes Assistance Services Corporation identifies the purposes for which personal information is collected.
Limited Use, Disclosure and Retention
Sykes Assistance Services Corporation uses, discloses and retains personal information for purposes consistent with the purpose for which it was collected. Use and disclosure for other purposes is by consent of the individual or as authorized by legislation.
Accuracy
Sykes Assistance Services Corporation makes all reasonable efforts to ensure that personal information collected, used or disclosed by or on behalf of Sykes Assistance Services Corporation is accurate and complete.
Safeguards
Sykes Assistance Services Corporation protects personal information in its custody or control by deploying security measures and practices to prevent unauthorized access, collection, use, disclosure, copying, modification, disposal or destruction. Sykes Assistance Services Corporation uses contractual or other means to provide a comparable level of protection while the information is in a service provider’s possession, including appropriately executed business agreements, when deemed necessary.
For that portion of our business that provides limited legal service to the public, Sykes Assistance Services Corporation’s legal professionals are governed by the Rules of Professional Conduct and all of the personal information collected by those professionals is protected by solicitor-client privilege. As such a lawyer must never disclose any information without written instruction from the client. The applicable privacy legislation does not abrogate solicitor-client privilege.
Right of Access
Individuals have a right to access information that Sykes Assistance Services Corporation holds about them, subject only to limited and specific exceptions. Individuals who believe there is an error or omission in their personal information have a right to request correction or amendment of the information.
Compliance Challenges
Individuals are encouraged to bring any concerns or issues regarding privacy to the Privacy Officer for discussion and response. Individuals may appeal to the Information and Privacy Commissioner of Canada to review or investigate the corporation’s response to the individual’s access to information request or a request for correction, or any policies or practices that they feel are not in compliance with legislative requirements. |
